Rather than count how much cannabis they contained — which was within the limits of the law — the prosecution counted the total weight of the brownies. “The jury perceived me as another black guy with marijuana, and I was found guilty and had to go to jail.” He was there for 33 days, then was sentenced to five years probation. Earl Carruthers is a business owner and the first POC dispensary owner in the state of Michigan.. He was party to two historic Michigan Supreme Court cases, one changing the legal definition of ‘edibles” in the enactment of Michigan HB 4210.
